Why is the Pyramid Scheme Illegal?
Pyramid schemes violate the law because they do not offer any product or services. They make their living by exploiting people who join them.
Top pyramid affiliates make it easy for people to join their ranks. They pay a small percentage of the new payments, but most of the profits.
High returns and immediate benefits make it attractive to join the ranks. Recruitment agencies won't have enough people to fill the pyramid.

The Federal Trade Commission is an independent US government agency that enforces antitrust laws (non-criminal). It also protects consumers.
The FTC brought suit against Vemma Nutrition Company, Vemma International Holdings, Inc. after discovering that they were involved in pyramid schemes.
Jessica Rich, Director of FTC’s Bureau of Consumer Protection stated that Vemma makes false claims of high-income potential rather than focusing its efforts on selling products to convince consumers to buy their products.
Federal Trade Commission (FTC) Calls Vemma A Pyramid Scheme That Preys On Young Adults
Antoine Gara (Fox staff writer) wrote that Vemma was being used to deceive its young members by the Federal Trade Commission (FTC).
Boreyko founded the company in 2004. The company quickly grew to include colleges all over the country. In 2013, it earned more than $200 million.
FTC claimed that the company was primarily focused on recruiting distributors. Many of those who signed up fell for high-income claims and lost all their money.
Vemma appealed and US District Judge John Tuchi ruled for Vemma. In 2015, the company was forced to stop multi-level marketing operations.
Vemma Agrees To Ban On Pyramid Scheme Practices To Settle FTC Charges
The FTC lawsuit forced the company to stop all business practices that were referred by the Federal Trade Commission to as pyramid schemes.
The Federal Court ordered them to stop paying affiliates unless they make a substantial portion of their income from customers. FTC also prohibited the firm from making unfounded income claims and offering unfounded benefits.
"Unfortunately excessive income claims and compensation programs that reward sales over recruiting continue to plague MLM industry,"said Jessica Rich, FTC Bureau of Consumer Protection.
Tempe's Vemma settles to FTC; Fined $238 Million, Accepts No Wrongdoing
Vemma reached a settlement with the FTC in 2016.
Bethany Alzakin, and Tom Alzakin were also penalized more than $6.7million and ordered to forfeit some business assets.
Vemma and Herbalife
Side note - Bill Ackman, Perishing Square, released a press release saying that Vemma had "significant structural similarities" to Herbalife after Vemma's closure.
Bill Ackman stated that Herbalife was similar to Vemma and other MLM companies that were closed down by FTC.
Is Vemma A Pyramid Scheme?
It was a pyramid scheme. The Federal Trade Commission has allowed affiliates, mostly college students to make money selling products without needing to recruit.
However, it is possible to create a successful online business that is profitable.
It's proof of this success and not Vemma’s which was just a few days ago.
