Let's look at some of the drama Herbalife has been in over the years.
David Einhorn was a hedge fund manager who asked Des Walsh, Herbalife president how many sales were made outside the company's network during 2012. That is what Mr. Walsh responded to.
"We don’t keep track of this number and don’t believe it is relevant. "
David Einhorn was, as you can see, furious. He placed a $1-billion bet against Herbalife shortly thereafter.
Michael Johnson was Herbalife's CEO and decided to fight back. Johnson called Ackman’s statements misleading.
Carl Icahn jumped in to label Ackman a liar and said that his claims were complete bullshit.
The worst month was March when a front-page story in The New York Times exposed the truth about Ackman.
Ackman was lobbying public officials and had even donated funds to anti-Herbalife advocacy organizations. Herbalife officials claimed that this was a fabrication, and then they publicly admitted two days later that they were under investigation by the Federal Trade Commission.
Ackman stated that he believed Herbalife was a global pyramid scheme.
John DeSimone, Herbalife's chief financial officer, responded to the statement saying that he was 100% certain Bill Ackman was mistaken. He had stepped out of the legal role as a short seller and crossed an ethical line.
Herbalife was ordered by the US in 2016 to pay $200 million for 'unfair and deceptive practices.
It doesn't stop there.
Why is Herbalife such a bad product?
Herbalife has been around for nearly two decades. In addition to paying millions of dollars for restructuring its United States operations, the FTC also spent millions.
Edith Ramirez (FTC Chairwoman) stated that Herbalife had made people think they were making a big deal of nutritional supplements.
Today Carl Ichan will give all of his Herbalife stock back for $600,000,000.
He would never do it again after the fight with Bill Ackman many years ago.
Who's Bill Ackman?
Bill Ackman (head of Pershing Square's hedge fund) played a controversial role in many of Herbalife's misleadings exposures.
Ackman fought Herbalife for 2 years.
Ackman bet $1 billion that Herbalife's stock would crash. He also talked about how Herbalife did not offer any real opportunities for its members to make money.
This was the first step in exposing how Herbalife deceived customers.
Herbalife claimed Ackman said these statements because Perishing Square investors would benefit from Herbalife's Wall Street collapses.
Why is Herbalife prohibited in the USA?
Herbalife was required to "fundamentally transform" its business in 2016 as part of a settlement with the U.S. Federal Trade Commission. Following allegations of a pyramid scheme, Herbalife was forced to "fundamentally reform" its business as part of a 2016 settlement with the U.S. Federal Trade Commission.
Many states in the United States had banned the use of ephedrine-containing herbal supplements by 2002. Herbalife products were also affected by the change. In July 2016, Herbalife agreed to modify its business model and pay $200 million to its distributors.

According to the company, only 704 U.S. citizens earned more than $100,000 a year in 2013.
